Apple Standard EULA is the base license
This page supplements, and does not replace, Apple's Standard EULA. Apnea Trainer uses Apple's Standard Licensed Application End User License Agreement as its base end user license for App Store distribution.
Apple's Standard Licensed Application End User License Agreement is incorporated into this agreement by reference. You should read both documents. Together, Apple's Standard EULA and this supplement form the license governing your use of Apnea Trainer on iOS, iPadOS, and watchOS.
If this supplement conflicts with Apple's Standard EULA, Apple's Standard EULA controls to the extent of the conflict. Nothing here limits rights or obligations that cannot be limited under applicable law or Apple's required App Store terms.
Provider and licensed application
Apnea Trainer is provided and licensed by Cedar Theory LLC. The licensed application is the dry-land breath-hold trainer named Apnea Trainer, which may also display as Freediving Trainer, with bundle identifier com.cedar.Freediving-Trainer.
Cedar Theory LLC, not Apple, is responsible for the app and its content, subject to the responsibilities assigned to Apple in Apple's Standard EULA and other applicable Apple terms.
Licence and permitted use
This End User License Agreement is a license to use Apnea Trainer on Apple devices signed in with your Apple ID. It is personal, non-exclusive, and non-transferable. Family Sharing or similar use is permitted only when and to the extent allowed by Apple.
Subject to Apple's Standard EULA, this supplement, and the terms of use, Cedar Theory LLC grants you a limited, revocable license to use the app on Apple-branded products that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The app is licensed, not sold. No ownership interest transfers to you.
You may not copy, reverse engineer, or resell the app except where applicable law expressly permits it.
Dry-land breath-hold training only
The app is dry-land breath-hold training. It is not for use in water. It is not a medical device and does not diagnose, treat, cure, or prevent any medical condition.
You agree to stay on dry land, lie down on a soft surface, keep your face clear, and breathe normally. You agree not to use the app in a pool, the sea, a bath, or any other setting where a blackout would be unsafe.
We do not offer medical advice. Any and all recommendations should be viewed as suggestions. Please consult with your doctor before making any medical decisions.
Access and purchases
Access is managed by Apple. Tables, timer, and log stay free either way. Full Access is offered through StoreKit:
- Yearly plan: 7 days free, then $14.99 a year unless Apple displays a different localized price. Renews until you cancel in Settings.
- One-time plan: $19.99, or the localized price Apple shows, and never renews.
Payment is charged to your Apple Account when you confirm the purchase. The yearly plan renews automatically unless canceled according to Apple's subscription terms. Deleting the app does not cancel a subscription. Use Restore purchases in the app to restore eligible access associated with your Apple ID. Additional purchase terms appear in the terms of use.
Acceptable use
You may not:
- Use the app in water or while swimming, diving, or bathing
- Copy, redistribute, sell, rent, lease, sublicense, or commercially exploit the app or its content
- Reverse engineer, decompile, disassemble, or attempt to derive source code except where applicable law expressly permits it
- Circumvent purchase verification, access controls, usage limits, or security features
- Interfere with the app, StoreKit, the App Store, or another person's use
- Use the app for unlawful or fraudulent activity
Privacy
Training answers stay on this phone. We do not send your hold times or name to a Cedar Theory LLC server. Restore uses your Apple ID on this device only. See the privacy policy.
Availability and disclaimers
The app is provided as is. Cedar Theory LLC may maintain, update, modify, suspend, or discontinue features. To the fullest extent permitted by law, and in addition to the disclaimers in Apple's Standard EULA, the app is provided without warranties of uninterrupted availability, accuracy, fitness for a particular purpose, or compatibility with every device or future operating system.
To the fullest extent permitted by law, Cedar Theory LLC is not liable for injury from misuse, including any in-water use, or for indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the app. Nothing here excludes warranties, remedies, or consumer rights that cannot legally be excluded.
Termination
This license remains effective until terminated. It terminates automatically if you materially violate Apple's Standard EULA or this supplement. Upon termination, you must stop using and delete the app. Canceling a subscription ends future renewal but does not itself terminate the app license. Deleting the app does not cancel a subscription.
Changes to this supplement
Cedar Theory LLC may update this supplement to reflect changes to the app, purchases, Apple requirements, or applicable law. The revised version will be posted on this page with an updated effective date. Changes do not alter Apple's Standard EULA.
